Criminal Defense

“We, as criminal defense lawyers, are forced to deal with some of the lowest people on earth, people who have no sense of right and wrong, people who will lie in court to get what they want, people who do not care who gets hurt in the process. It is our job - our sworn duty - as criminal defense lawyers, to protect our clients from those people."

                                                                                        Cynthia Rosenberry

You should never talk to a police officer. However, if you simply
cannot resist the urge, I suggest you say only the following:

I want to cooperate but, I refuse to consent to any search whatsoever. As such, I do not consent to a search of my premises, my person, my immediate location or any vehicle or effects. My attorney has advised me not to talk to anyone, not to answer any questions, and not to reply to accusations. Call my attorney if you want to ask questions, search me or my property, do any tests, do any lineups, or any identification procedures. I do not agree to any of these things without my attorney present and I do not want to waive any of my constitutional rights.

                                    A NOTE ABOUT COURT-APPOINTED COUNSEL

Some lawyers who defend the indigent -- especially public defenders -- are heroes of ours. They are overworked and underpaid, but they do a terrific job of representing the oppressed.

If you are appointed a lawyer in a criminal case in Michigan, your court-appointed lawyer may be a truly outstanding attorney. He may also be an incompetent hack. By the same token, if you hire a lawyer for a criminal case in Michigan, your retained lawyer might be either a fine attorney or a bungler.

One major difference between court-appointed counsel and retained counsel, though, is that you can't choose your court-appointed counsel. You get what the judge gives you.

If you retain an attorney you make the choice.
